Terms of Use

These Terms of Use explain the rules for using thebeaumontstudios.com, B-Side Radio features connected to the site, and the forms and online services operated by The Beaumont Studios.

Please also read our Privacy Policy, which explains how we collect, use, and protect personal information.

Agreement and operator

The Beaumont Studios Artist Society, operating as The Beaumont Studios, is a Vancouver, British Columbia arts charity. In these terms, “The Beaumont,” “we,” “us,” and “our” refer to The Beaumont Studios Artist Society and the services it operates, including B-Side Radio.

By accessing or using this site, its forms, or features connected to it, you agree to these terms. If you do not agree, please do not use those services.

Some bookings, events, tickets, programs, payments, rentals, leases, and agreements have additional terms. If a separate written agreement applies, that agreement controls the specific transaction where it conflicts with these general website terms.

Using the site and forms

You may use the site for lawful purposes connected to learning about, contacting, supporting, booking, or participating in The Beaumont and its programs.

When you submit a booking enquiry, artist or gallery proposal, studio application, event promotion request, volunteer form, contract form, or other information, you agree to:

  • Provide information that is accurate, current, and not misleading.
  • Use your own identity or have permission to act for the person or organization you name.
  • Provide only material you are entitled to submit.
  • Update or correct important information if it changes.

You must not:

  • Use the site for unlawful, fraudulent, abusive, threatening, discriminatory, defamatory, or harmful activity.
  • Submit spam, malicious code, deceptive content, or material that violates another person’s privacy, intellectual-property, or other rights.
  • Attempt to gain unauthorized access to accounts, forms, systems, data, or administrative areas.
  • Interfere with the site, overload services, bypass security measures, scrape at unreasonable volume, or use automated tools in a way that disrupts normal operation.
  • Misrepresent an affiliation with The Beaumont or use our forms to impersonate another person or organization.

Submitting a form does not guarantee a booking, rental, exhibition, program place, event listing, contract, or response. We may reject, remove, or pause submissions that are incomplete, inaccurate, inappropriate, unlawful, or outside our capacity.

Materials you submit

You keep ownership of text, images, recordings, designs, and other original material you submit.

By submitting material, you confirm that you own it or have the permissions needed to provide it, including permission from identifiable people where required. You give The Beaumont a limited, non-exclusive permission to review, store, copy, resize, format, and use the material to administer your request.

If your event, artwork, program, broadcast, or submission is accepted or approved, that permission also allows us to use the submitted material to promote the related activity through our website, event calendar, newsletters, listings, radio channels, and social-media accounts. This permission is only for those operational and promotional purposes and does not transfer ownership to The Beaumont.

Contact us if you need to correct submitted material or withdraw permission for future use. We may not be able to recall material that has already been lawfully published, distributed, archived, or used to complete an agreement.

Intellectual property

The site contains text, photographs, artwork, designs, logos, event materials, videos, broadcasts, recordings, and other content. That content may belong to The Beaumont, individual artists, broadcasters, photographers, event producers, licensors, or other creators.

You may view and use the site for ordinary personal and informational purposes. You may not copy, republish, distribute, sell, modify, broadcast, train a commercial model on, or otherwise reuse site content without permission from the applicable rights holder, except where the law permits.

Displaying an artist’s work, a broadcast recording, or third-party material on our site does not transfer ownership or give visitors permission to reuse it.

Bookings, payments, signatures, and third-party services

Parts of our services are provided through or link to independent providers. These may include Showpass or Eventbrite for ticketing, Square and other providers for payments, DocuSeal for electronic signatures, Keela for fundraising forms, RadioCult for radio streaming, Google services, embedded form providers, and social-media platforms.

Your use of a third-party service is also subject to that provider’s terms and privacy policy. The provider is responsible for its own platform, processing, availability, and security. The Beaumont is not responsible for independent services beyond the extent required by law.

Prices, availability, schedules, capacities, program details, and event information can change. A booking, ticket, payment confirmation, signed agreement, or direct written confirmation from The Beaumont is required where the relevant service calls for one.

YouTube features

Our services include content and features connected to YouTube. By using YouTube features through our services, you also agree to the YouTube Terms of Service.

Availability, disclaimers, and liability

Site availability and information

We work to keep the site useful, accurate, and available, but we do not promise that every page, form, link, schedule, price, or third-party feature will always be complete, current, uninterrupted, secure, or error-free. Website information is general information and is not legal, financial, safety, or professional advice.

We may change, suspend, restrict, or discontinue a page, form, feature, or service when reasonably necessary for operations, security, maintenance, legal compliance, or program changes.

Reasonable limitation of liability

To the fullest extent permitted by law, The Beaumont and its directors, staff, contractors, and volunteers are not responsible for indirect, incidental, special, or consequential losses arising from use of the site, inability to use the site, reliance on website information, loss of submitted data, or the acts or failures of independent third-party services.

If The Beaumont is legally responsible for a website-related loss, our responsibility is limited to direct and reasonably foreseeable loss. Nothing in these terms excludes or limits liability, remedies, or rights that cannot legally be excluded or limited.

Privacy

Our Privacy Policy explains what information we collect, how we use it, the service providers connected to the site, retention, privacy requests, and our use of YouTube API Services.

Changes to these terms

We may update these terms as our website, services, or legal obligations change. The date at the top of this page shows when the terms were last updated. Your continued use of the site after an update means the updated terms apply to future use.

Governing law

These terms are governed by the laws of British Columbia and the applicable laws of Canada. Any dispute relating to these terms or use of the site will be handled by the courts of British Columbia, unless applicable law requires otherwise.
